Terms of service
Last updated: 7 October 2026
Overview
Welcome to Syvaire. The terms “we”, “us” and “our” refer to Syvaire. Syvaire operates this shop and website, including all related information, content, features, tools, products and services, to provide you with a curated shopping experience (the “Services”). Syvaire is powered by Shopify, which enables us to provide the Services to you.
These terms and conditions, together with any policies referred to in them (these “Terms of Service” or “Terms”), set out your rights and obligations when you use the Services.
Please read these Terms carefully. They contain important information about your legal rights, including limitations on our liability. Nothing in these Terms affects your statutory rights as a consumer.
By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not use or access our Services.
Section 1: Access and account
By agreeing to these Terms, you confirm that you are at least 18 years old. You also confirm that you have given consent for any minors in your care to use the Services on devices you own, buy or manage.
To use the Services, including browsing our online shop or buying our products or services, you may be asked to provide certain information, such as your email address and payment and delivery details. You confirm that all information you provide in our shop is accurate, current and complete, and that you have the right to provide it.
You are responsible for keeping your account details secure and for all activity on your account. You may not transfer, sell, assign or license your account to anyone else.
Section 2: Our products
We do our best to show our products and services accurately in our online shop. Please note that colours and product appearance may vary slightly from how they appear on your screen, depending on your device and its settings.
All products we sell must be as described, of satisfactory quality and fit for purpose, as required by the Consumer Rights Act 2015. If a product does not meet these standards, please see our Returns & Refunds Policy.
We may change product descriptions at any time. Changes will not affect orders we have already confirmed. We may discontinue any product at any time and may limit the quantities we offer to any person, region or jurisdiction on a case-by-case basis.
Section 3: Orders
When you place an order, you are making an offer to buy. We may accept or decline your order at our discretion. Your order is only accepted when we confirm it by email, and we must have received and processed your payment before we accept it. If we decline, change or cancel an order, we will let you know using the email address, billing address and/or phone number you provided, and we will refund any payment you have made for it.
As a UK consumer, you have a legal right to cancel your order within 14 days of receiving it. Returns, exchanges and cancellations are handled in line with our Returns & Refunds Policy.
You confirm that your purchases are for your own personal or household use and not for commercial resale or export.
Section 4: Prices and payment
Prices, discounts and promotions may change without notice, but changes will not affect orders we have already confirmed. The price you pay is the price shown when you placed your order, as confirmed in your order confirmation email.
All prices are shown in pounds sterling (GBP) and include VAT. Delivery charges and any other charges are shown at checkout before you complete your order. For more information, see our Shipping Policy.
Prices in our online shop may differ from prices in physical shops or in online or other shops run by third parties. We may run promotions from time to time that affect pricing and are subject to their own terms and conditions. If the terms of a promotion conflict with these Terms, the promotion terms will apply.
You agree to provide current, complete and accurate purchase, payment and account information for all purchases made in our shop. You agree to update your account and other details promptly, including your email address and card numbers and expiry dates, so that we can complete your transactions and contact you when needed.
You confirm that (i) the payment card details you provide are true, accurate and complete, (ii) you are authorised to use that payment card for the purchase, (iii) charges you incur will be honoured by your card issuer, and (iv) you will pay the charges you incur at the prices shown, including delivery charges and applicable taxes.
Section 5: Delivery
Delivery times shown are estimates. Unless we agree otherwise, we will deliver your order within 30 days of accepting it. If we do not, you may be entitled to cancel your order and receive a refund. We are not responsible for delays caused by events outside our reasonable control, but we will let you know as soon as possible if your order is affected.
Products are our responsibility until they are delivered to you or to someone you have nominated. Ownership of the products passes to you once we have received full payment.
For more information, see our Shipping Policy.
Section 6: Intellectual property
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video and audio, and their design, selection and arrangement, are owned by Syvaire, its affiliates or licensors and are protected by UK and international copyright, trademark, patent and other intellectual property laws.
These Terms allow you to use the Services for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store or transmit any material on the Services without our prior written consent. Except as expressly stated in these Terms, nothing in these Terms grants you, or should be read as granting you, a licence or any other right under any patent, trademark, copyright or other intellectual property of Syvaire, Shopify or any third party. Unauthorised use of the Services may breach applicable intellectual property laws. All rights not expressly granted in these Terms are reserved by Syvaire.
The Syvaire name, logos, product and service names, designs and slogans are trademarks of Syvaire or its affiliates or licensors. You may not use them without Syvaire's prior written permission. Shopify’s name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs and slogans on the Services are the trademarks of their respective owners.
Section 7: Optional tools
You may be given access to customer tools provided by third parties as part of the Services. We do not monitor, control or have any input into these tools.
These tools are provided “as is” and “as available”, without any warranties, representations or conditions, and without any endorsement. To the extent permitted by law, we have no liability arising from or relating to your use of optional third-party tools.
You use any optional tools offered through the site entirely at your own risk and discretion. You should make sure you are familiar with, and accept, the terms on which the relevant third-party provider offers the tools.
We may also offer new features through the Services in the future, including new tools and resources. Any new features will also form part of the Services and are subject to these Terms.
Section 8: Third-party links
The Services may contain materials and links to websites provided or operated by third parties, including any embedded third-party functionality. We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you choose to access. If you choose to leave the Services to access such materials or websites, you do so at your own risk.
We are not liable for any harm or damages relating to your access to third-party websites, or your purchase or use of any products, services, resources or content on them. Please review the third party’s policies and practices carefully before entering into any transaction. Complaints, claims, concerns or questions about third-party products and services should be directed to the third party.
Section 9: Relationship with Shopify
Syvaire is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our shop are made directly with Syvaire. Shopify is not a party to the contract between you and Syvaire and is not responsible for any aspect of the sale, including any harm or loss arising from products and services you buy.
Section 10: Privacy
All personal data we collect through the Services is subject to our Privacy Policy. Some personal data may also be subject to the Shopify Consumer Privacy Policy. By using the Services, you acknowledge that you have read these privacy policies.
Because the Services are hosted by Shopify, Shopify collects and processes personal data about your access to and use of the Services in order to provide and improve them. Information you submit through the Services will be transferred to and shared with Shopify and with third parties that may be located in countries other than the one where you live, in order to provide services to you. See our Privacy Policy for more details on how we, Shopify and our partners use your personal data.
Section 11: Feedback
If you submit, upload, post, email or otherwise share any ideas, suggestions, feedback, reviews, proposals, plans or other content (together, “Feedback”), you grant us a perpetual, worldwide, sub-licensable, royalty-free licence to use, reproduce, modify, publish, distribute and display that Feedback in any medium and for any purpose, including commercial use. For example, we may use these rights to operate, provide, evaluate, improve and promote the Services and to perform our obligations and exercise our rights under these Terms.
You also confirm that (i) you own or have all necessary rights to all Feedback, (ii) you have disclosed any payment or incentive you received in connection with your Feedback, and (iii) your Feedback complies with these Terms. We are under no obligation to (1) keep your Feedback confidential, (2) pay you for your Feedback, or (3) respond to your Feedback.
We may, but are not obliged to, monitor, edit or remove Feedback that we reasonably consider unlawful, offensive, threatening, defamatory, pornographic, obscene or otherwise objectionable, or that infringes anyone’s intellectual property or these Terms.
You agree that your Feedback will not infringe any third party’s rights, including copyright, trademark, privacy or other personal or proprietary rights. You also agree that your Feedback will not contain defamatory or otherwise unlawful, abusive or obscene content, or any computer virus or other malware that could affect the operation of the Services or any related website. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third parties about the origin of any Feedback. You are solely responsible for any Feedback you submit and for its accuracy. We take no responsibility for Feedback posted by you or any third party.
Section 12: Errors, inaccuracies and omissions
Occasionally, information on the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, offers, delivery charges, delivery times and availability. We may correct any errors, inaccuracies or omissions and change or update information at any time.
If we discover an obvious error in the price or description of a product after you have placed your order, we will contact you. We may cancel the order and give you a full refund, or offer you the option to continue at the correct price.
Section 13: Prohibited uses
You may only access and use the Services for lawful purposes. You may not access or use the Services, directly or indirectly: (a) for any unlawful or malicious purpose, (b) to breach any international, UK or local law or regulation, (c) to infringe our intellectual property rights or those of others, (d) to harass, abuse, harm, defame or intimidate our staff or any other person, (e) to submit false or misleading information, (f) to send, knowingly receive, upload, download, use or re-use any material that does not comply with these Terms, (g) to send, or arrange the sending of, any advertising or promotional material, including “spam” or similar, (h) to impersonate any other person or entity, or (i) to otherwise restrict or prevent anyone’s use or enjoyment of the Services, or in any way that, in our reasonable opinion, may harm Syvaire, Shopify or users of the Services or expose them to liability.
You also agree not to (a) upload or transmit any virus or other harmful code that will or may affect the functionality or operation of the Services, (b) reproduce, copy, sell, resell or exploit any part of the Services, (c) collect or track personal data about others, (d) spam, phish, crawl or scrape the website, or (e) interfere with or get around the security features of the Services or any related website or other websites. We may suspend, deactivate or close your account at any time if we reasonably believe you have breached these Terms.
Section 14: Termination
We may end this agreement or your access to the Services (or any part of them) at any time if we reasonably believe you have breached these Terms. You will remain liable for any amounts owed up to and including the date of termination. Termination does not affect any orders we have already confirmed, unless the termination relates to those orders.
The following sections will continue to apply after termination: Intellectual Property, Feedback, Termination, Disclaimer, Limitation of Liability, Your Responsibility, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy, and any other provisions that by their nature should survive termination.
Section 15: Disclaimer
General information on or through the Services is provided for general information purposes only. We do our best to keep it accurate and up to date, but we cannot guarantee that it is always complete or current.
We do not guarantee that your use of the Services will be uninterrupted, timely, secure or error-free.
Nothing in these Terms affects your statutory rights as a consumer, including your rights under the Consumer Rights Act 2015 that products are as described, of satisfactory quality and fit for purpose.
Section 16: Limitation of liability
We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen, or if both you and we knew it might happen when the contract was made.
We supply products for domestic and private use only. We are not liable to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
We do not exclude or limit our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for breach of your statutory rights as a consumer.
Section 17: Your responsibility
You are responsible for any loss or damage we suffer as a direct and foreseeable result of your breach of these Terms, your breach of any law or third-party rights, or your misuse of the Services.
Section 18: Severability
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will still apply to the fullest extent permitted by law, and the unenforceable part will be treated as removed from these Terms. This will not affect the validity and enforceability of the remaining provisions.
Section 19: Waiver and entire agreement
If we fail to exercise or enforce any right or provision of these Terms, this does not mean we have waived that right or provision.
These Terms, together with any policies or operating rules we publish on this website or in connection with the Services, form the entire agreement between you and us and govern your use of the Services. They replace any previous or simultaneous agreements, communications and proposals, whether oral or written, between you and us, including previous versions of these Terms.
If there is any doubt about the meaning of a term in these Terms, the interpretation most favourable to you will apply.
Section 20: Assignment
You may not assign, transfer or delegate this agreement or any of your rights or obligations under these Terms without our prior written consent. We may transfer our rights and obligations under these Terms to another organisation. If we do, we will let you know, and this will not affect your rights under these Terms.
Section 21: Governing law
These Terms are governed by the laws of England and Wales. You can bring legal proceedings in respect of the products or Services in the courts of England and Wales. If you live in Scotland, you can bring legal proceedings in either the Scottish or the English courts. If you live in Northern Ireland, you can bring legal proceedings in either the Northern Irish or the English courts.
Section 22: Headings
The headings in this agreement are included for convenience only and do not limit or otherwise affect these Terms.
Section 23: Changes to these Terms
You can review the most current version of these Terms at any time on this page.
We may update, change or replace any part of these Terms by posting updates and changes on our website. We will notify you of material changes to these Terms as required by law, and such changes will take effect on the date stated in the notice. Changes will not affect orders you have already placed. The Terms that apply to your order are the Terms in force at the time you placed it.
